This disclaimer governs your use of the Fletcha Eats website, mobile apps and services (collectively, the "Platform"). By using the Platform you accept this disclaimer in full. If you disagree with any part, please stop using the Platform.
1. Marketplace role
Fletcha Eats is a technology platform that connects customers with independent businesses (restaurants, shops, service providers) and independent delivery drivers. We are not the seller of any goods listed on the Platform, and we are not the employer of any driver. Each business is solely responsible for the items it offers, including quality, hygiene, food safety, expiry, packaging and accuracy of menus, prices and stock. Each driver is solely responsible for the manner in which they collect, transport and hand over an order.
2. No professional advice
Content on the Platform is provided for general information only and does not constitute medical, legal, financial or professional advice. Always rely on the seller's own product information for ingredients, allergens, dosage or fitness for purpose.
3. Pricing, availability and promotions
Prices, fees, delivery times, distances, stock and promotional offers may change without notice. We make reasonable efforts to keep information accurate but do not warrant that any listing, fee estimate, ETA or distance shown on the Platform is error-free.
4. Third-party stores (Personal Shopper)
When you ask a driver to shop on your behalf, the named store (for example Boxer, Shoprite, Spar, Pick n Pay, Clicks, etc.) is independent of Fletcha Eats. We are not affiliated with, sponsored by or endorsed by those stores unless we explicitly say so. Read the Personal Shopper Disclaimer for full terms.
5. Payment processors
Where the Platform integrates with third-party payment processors (for example PayFast, Yoco, Capitec Pay, or bank EFT), those processors are independent service providers and operate under their own terms and privacy policies. Fletcha Eats is not liable for any act, omission, downtime, fraud, chargeback or dispute attributable to a payment processor. By using a payment method on the Platform you also agree to the processor's own terms.
6. GPS, maps and ETAs
Map data, distance calculations, GPS tracking and estimated times of arrival are sourced from third-party providers and the driver's device. They are estimates, not guarantees. Reception, signal strength, traffic and device accuracy can affect results.
7. Limitation of liability
To the maximum extent permitted by South African law, Fletcha Eats is not liable for:
- Loss of profit, revenue, data, goodwill or anticipated savings;
- Indirect, consequential, incidental or special damages of any kind;
- Damage caused by the acts, omissions, negligence or unlawful conduct of a business, driver, customer or third-party service provider;
- Interruptions, errors, viruses, downtime or unavailability of the Platform;
- Inaccurate, late or incomplete delivery caused by factors outside our reasonable control (load shedding, weather, protests, network outages, vehicle breakdown).
Our total aggregate liability for any claim arising out of or relating to your use of the Platform shall not exceed the amount of fees you paid to Fletcha Eats (excluding amounts paid to a business or driver) in the 3 months preceding the event giving rise to the claim.
8. Consumer Protection Act
Nothing in this disclaimer limits, excludes or modifies any consumer right that cannot lawfully be limited, excluded or modified under the Consumer Protection Act 68 of 2008 or any other applicable South African law. Where a provision is found to be unenforceable, it is severed and the remainder continues in force.
9. External links
The Platform may contain links to third-party websites. We provide them for convenience and do not endorse or accept responsibility for the content or practices of those sites.
10. Force majeure
Fletcha Eats is not liable for any failure or delay caused by events beyond our reasonable control, including natural disasters, riot, war, governmental action, pandemic, strike or failure of utilities, telecommunications or payment networks.
11. Changes
We may update this disclaimer from time to time. Material changes will be highlighted in the Platform. Continued use after a change means you accept the updated disclaimer.
