These Terms govern your use of Fletcha Eats. By creating an account or using the app you agree to be bound by them, along with our Privacy Policy, Acceptable Use Policy and the role-specific terms that apply to you (customer, driver or business).
1. How Fletcha Eats works
Fletcha Eats is a marketplace platform. We connect:
- Customers who want food, groceries or items delivered.
- Businesses who sell those goods.
- Independent drivers who collect and deliver them.
We are not the seller of goods supplied by businesses, and drivers are independent contractors, not employees of Fletcha Eats. We provide the technology that makes the transaction possible and we facilitate communication, payment proofs and dispute resolution.
2. Account creation
- You must be at least 18 years old (or 13 with a parent's permission for a customer account).
- You must give accurate name, phone and email details.
- You may only hold one personal account. Businesses and drivers register separately.
- You must accept these Terms and the Privacy Policy during sign-up.
- Drivers and businesses must complete additional verification before going live.
3. Customer responsibilities
- Provide a correct delivery address and accurate GPS pin.
- Pay the agreed amount using one of the business's accepted payment methods.
- Upload genuine proof of payment when EFT, Capitec Pay or similar is used.
- Be available to receive the driver at the agreed location.
- Treat drivers and business staff with respect.

4. Driver responsibilities
- Hold valid ID, driver's licence (where required) and vehicle documents.
- Only go online when sober, safe to drive and willing to accept jobs.
- Accept only one active delivery at a time and complete it before taking another.
- Show the proof code at the shop, confirm pickup, then deliver to the customer's GPS location and confirm with the customer's delivery code.
- Never tamper with food or items in transit.

5. Business responsibilities
- Sell only goods that are legal and safe to deliver.
- Keep menus/products, prices, opening hours and GPS coordinates accurate.
- Verify payment proofs before marking an order ready.
- Prepare orders within reasonable time and hand over to the assigned driver only.

6. Platform rules
- No illegal goods or services (drugs, weapons, alcohol to minors, stolen goods, etc.).
- No fake accounts, fake reviews or fake payment proofs.
- No abusive, threatening or discriminatory behaviour towards anyone on the platform.
- No attempting to bypass the platform (e.g. asking the driver to do an off-app deal).
7. Fraud prevention
We use automated and human checks to detect suspicious activity, including but not limited to: repeat cancellations, fake GPS, fake payment proofs, multiple accounts, and abnormal earning patterns. We may temporarily restrict, suspend or permanently close an account where we have reasonable grounds to suspect fraud.
8. Account suspension and termination
We may suspend or terminate an account when:
- You break these Terms or any role-specific terms.
- You commit, attempt or facilitate fraud.
- Your trust score drops below the minimum threshold after repeated cancellations or complaints.
- Your driver or business documents expire or are found to be false.
- Required by law or to protect the safety of our community.
9. Dispute handling
Disputes are handled in line with the Refund & Dispute Policy. Open the order in the app and tap "Dispute" (or use Support) within 24 hours of delivery.
10. Limitation of liability
To the maximum extent permitted by South African law (including the Consumer Protection Act), Fletcha Eats is not liable for:
- The quality, safety or legality of goods sold by businesses.
- The conduct of drivers off-platform or beyond a delivery's scope.
- Indirect, incidental or consequential losses (e.g. lost profits) arising from delays.
Nothing in these Terms excludes liability that cannot lawfully be excluded (for example, for gross negligence, fraud, or rights you have as a consumer under the Consumer Protection Act 68 of 2008).
11. Governing law
These Terms are governed by the laws of the Republic of South Africa. Any dispute that cannot be resolved through our internal process is subject to the jurisdiction of the courts of South Africa.
12. Changes
We may update these Terms from time to time. We will tell you in-app when we do. Continued use after a change means you accept the updated Terms.
